European Court of Justice: Its Role in the EU and Member States
In this episode, we explore the CJEU's role and its significance in ensuring uniform interpretation and application of EU law across member states. Our guest, professor Federico Casolari of the University of Bologna, sheds light on a case involving Italy's compliance with EU waste management directives. The Court held Italy accountable for its failure to properly implement the directive, imposing significant fines. Additionally, we examine an ongoing case concerning Italy's adherence to the Bolkestein Directive on the free movement of services, particularly in the context of concession procedures. With potential implications for Italy's economy, especially in the tourism sector, the outcome of this case remains uncertain pending the Court's verdict.
